At StayScape Studio, we can transform existing photography and other approved creative assets into engaging, AI-assisted video content—adding motion, building visual narratives, and helping businesses get more value from the content they already have.

But with that capability comes responsibility.

Using artificial intelligence does not eliminate copyright, licensing, privacy, publicity, trademark, or advertising considerations. That’s why StayScape Studio takes a rights-conscious approach to every AI-assisted project we produce.

Here’s what that means for our clients.

AI Doesn’t Override Copyright

A common misconception is that putting an image through an AI platform somehow creates a completely new asset free from the rights attached to the original.

That isn’t how StayScape Studio approaches AI content.

Photographs and other creative works may be protected by U.S. copyright law. Using AI to animate, transform, or incorporate an image into a video does not automatically eliminate the rights associated with the original work.

For that reason, StayScape Studio requires clients to own their submitted materials or possess the appropriate licenses or permissions to use them for the intended project.

For stock photography, ownership isn't necessarily required. Instead, the applicable license must permit the intended commercial use and any relevant processing or modification.

We Consider More Than Who Owns the Photo

Copyright is only part of responsible content creation.

A client may have every right to use a photograph while other rights remain relevant to what appears inside that photograph.

For example, an image could include an identifiable person, artwork, a third-party logo, signage, branded products, or other protected material.

StayScape Studio therefore asks clients to confirm that they have the permissions, releases, licenses, and other rights reasonably necessary for the materials they provide.

For images containing identifiable people, this can include appropriate permission for the commercial use of a person's name, image, likeness, or voice.

We Take AI Alteration Seriously

AI can do much more than simply display a photograph.

It can make a still image move. It can alter environments. It can generate new visual details. Some technologies can even make a person appear to speak or perform actions that never occurred.

That power requires additional care.

StayScape Studio does not treat possession of a photograph as automatic permission to fabricate an endorsement, testimonial, statement, or action by the person depicted.

When AI-assisted modifications are part of a project, we seek client authorization for the contemplated processing and expect clients to have the necessary rights and permissions for the source material they provide.

We also believe AI-generated or AI-modified content that could materially affect the meaning or accuracy of an advertisement deserves particular scrutiny before publication.

We Don't Use AI to Invent Marketing Claims

AI is a creative production tool—not a substitute for factual accuracy.

Prices, promotions, property information, statistics, product or service claims, testimonials, before-and-after representations, and other factual advertising content supplied for a project remain subject to review and approval.

StayScape Studio expects clients to provide accurate information and substantiate advertising claims where required.

We do not intentionally use AI to create a false testimonial or make a real person appear to endorse a company, property, product, or service without appropriate authorization.

We Respect Trademarks and Third-Party Content

Logos, brand names, artwork, screenshots, signage, and other third-party materials may carry rights separate from the copyright in the photograph that contains them.

StayScape Studio therefore asks clients to confirm that they are authorized to provide third-party materials specifically requested for inclusion in their videos.

We also seek to avoid creating content that falsely suggests another company, organization, or individual sponsors, endorses, or is affiliated with a client.

Clients Know When Their Assets May Be AI-Processed

Responsible AI production also means being transparent about the workflow.

When appropriate to the project, client-provided materials may need to be processed using third-party AI and video-production technology.

Our client intake process addresses authorization for this type of processing and gives clients an opportunity to identify special restrictions before production begins.

Clients should not provide confidential, sensitive, proprietary, or private materials for AI processing unless their use has been specifically discussed and authorized.

Human Creativity Remains Part of Our Process

StayScape Studio doesn't view AI as a replacement for creative direction.

Our work can involve decisions about narrative, pacing, editing, composition, sequencing, messaging, visual direction, and how the final piece communicates the client's story.

Current U.S. Copyright Office guidance distinguishes between material generated by AI and copyrightable human contributions to AI-assisted works. The presence of AI does not necessarily make an entire work either copyrightable or uncopyrightable; the nature and extent of human authorship matter.

StayScape Studio therefore uses AI as part of a broader creative production process rather than assuming that pressing a “generate” button resolves questions of authorship or ownership.

Every Client Has Final Approval

One of our most important safeguards happens before a video is published.

The client reviews the finished work.

Our approval process is designed to allow clients to verify important details, including:

  • Names, logos, contact information, pricing, and offers

  • Factual and advertising claims

  • Representation of people, properties, products, and services

  • Use of supplied photography, video, logos, and other assets

  • AI-generated or AI-modified material that could reasonably be mistaken for reality

  • Overall approval for commercial publication

This creates a clear checkpoint between creative production and public-facing advertising.

Our Approach: Permission, Transparency, and Approval

AI technology is evolving quickly, and the legal framework surrounding it continues to develop.

StayScape Studio doesn't believe responsible creators should wait for every legal question surrounding AI to be settled before adopting good practices.

Our approach is straightforward:

Use authorized assets. Respect the people depicted. Don't fabricate endorsements. Protect third-party rights. Keep advertising claims accurate. Be transparent about AI processing. Maintain meaningful human creative involvement. And obtain client approval before publication.
